Human mobility, greatly stimulated due to the facilitation of access to information about the most distant countries and the visibility of different cultures, lifestyles and especially opportunities, visibility provided by globalization, although it could and should follow the same line of economic relations , whose transactions, products and services circulate more easily among the participating countries of a globalized economy, is not accepted by the vast majority of countries as a natural consequence of globalization. In other words, people cannot migrate freely, in search of better living conditions, unless they observe the rules established by States, which hold the ultimate decision-making power over the movement of people in their territories.

The foundation of the state decision on the entry and exit of people from the territories is found in the Immigration Law, in the establishment of norms that regulate each type of migration in a different way and in the migratory policy adopted by a given State.
